Terms & ConditionsYour statutory customer rights are not affected. Definitions Seller means Country Attire Ltd. (Meveril, Lesser Lane, Combs, High Peak, SK23 9UZ UK) and the company's web sites www.countryattire.com, www.equineinnovations.com, www.equineinnovations.co.uk, www.country-attire.com, www.country-attire.co.uk, www.countryattire.co.uk. Customer means the person or company to whom this document is addressed. 1. GENERAL These terms and conditions are applicable to the supply of products made by the Seller, hereafter referred as Country Attire Ltd., to the buyer hereafter referred as the Customer. 2. PRICE 2.1 All prices are quoted in British Sterling both Net and inclusive of VAT (IF APPLICABLE) (as may be prescribed by law from time to time), unless otherwise specified. 2.2 Prices are inclusive of postage and packing worldwide, unless otherwise stated. 3. PAYMENT Payments must be made in British Sterling unless otherwise specified, and by one of the following payment methods. Major credit cards as listed: Visa, MasterCard, Delta, Switch, Solo, Maestro, Visa Electron & American Express, Cheques made payable to Country Attire Ltd., Postal orders made payable to Country Attire Ltd. Paypal to payment@countryattire.com Your card is charged when your package is ready to be shipped. Please note that customers may be liable to pay for customs tax or import duty which may be added after shipping and which may be payable by the customer on receipt of the goods. 4. PASSING OF PROPERTY Country Attire Ltd. shall retain the property of the goods until full payment has been made by the customer and has been received. 5. PASSING OF RISK The risk in the goods shall pass to the Customer on delivery, as defined in clause 6.3 below. 6. DELIVERY 6.1 Delivery dates: Any date or period for delivery shall be considered as indicative only, although it is our policy to try to dispatch all orders within 1 working days, we aim for next working day delivery but cannot be guaranteed by any carrier. Any products not available at the time of your order will be sent to you as soon as possible, when received from the manufacturer. Country Attire Ltd. cannot be held responsible for delays in the delivery caused by the manufacturer, or any other third party. If an item is required by a specific date please indicate this on your order form when placing your order and we will endeavour to deliver by the date requested. When placing your order you should receive an automatic order confirmation by email, this will confirm the detail of your order, but is in no way an acceptance of your order or a guarantee of supply. Unless otherwise requested all communication with you by us will be through email, it is imperative that you correctly state your email address in your order. All orders are subject to security checking and stock availability. 6.2 SHIPPING We deliver Worldwide, including BFPO. Orders will be shipped via Courier or Royal Mail, orders over £30 UKP in value will require a signature on delivery, except where specifically requested otherwise by a customer (at their own risk). Packages over £100 UKP in value arrive within 1 working day by Special Delivery in the UK. All parcels are insured in transit. Delivery performance during busy times such as Christmas, may be slightly lower. Below is a guide for delivery times.
6.3 PASSING OF RISK In the event of an order being lost by a third party, Country Attire Ltd. bears no risk once it has left their trading premises. Where goods have been received damaged, a refund/exchange application will only be acknowledged if the goods are returned together with their original packaging within 14 days of order to Country Attire Ltd. trading address (see clause 13). Where the goods are signed for, the customer bears the risk once the goods are signed for. If a customer believes that a parcel has been tampered with, it is their responsibility to refuse to sign for the goods. In the event of either of the above, Country Attire Ltd. will forward a claim to the appropriate courier on the behalf of the customer. Before this can be processed, Country Attire Ltd. will issue the customer with a 'Lost Orders Form' which must be completed and returned before any claim can be pursued. This is not a guarantee and Country Attire Ltd. have the right to refuse any application. Any refund/exchange given is at the discretion of the management of Country Attire Ltd. Failure to give accurate information while making a claim may lead to a prosecution from the courier company. 7. ACCEPTANCE The Customer shall inspect the goods within a reasonable time after their receipt and shall be deemed to have accepted the goods unless within 21 days after their receipt the Customer shall have notified the seller that the goods are rejected. (This does not however affect the customer’s statutory rights). If no such action has been taken, Country Attire Ltd. shall consider the products being as described, of satisfactory quality and fit for their purposes, and may not accept any reject at a later date. 8. RETURNS PROCEDURE 8.1 If the goods are to be rejected in the time limit set in clause 7 above, the Customer shall comply with the return procedure as defined in clause 8.2, below. Country Attire Ltd. will not accept any returned goods should the return not follow the aforementioned return procedure. 8.2 The Customer must send all returns within 21 days of receipt to;
Returns Dept Any used, worn, damaged products or those with sales tags removed will NOT be eligible for a refund/exchange. It is advisable that a certificate of posting is obtained.
Please allow 28 days for your returned item to be delivered (within the UK) Products returned from outside the UK must be marked 'British Returned Goods' and a duly completed customs declaration must be affixed, stating that the products are being returned as they are either faulty, unwanted or for repair. If the correct documentation is not completed the Customer may be liable for any Customs or Import duties charged. We reserve the right NOT to accept any parcel which has a customs charge payable on it. 8.3 In cases where the rejection of the goods is due to a defect or discrepancy in the order, the Customer is entitled to a replacement. The faulty or damaged product must be returned to Country Attire Ltd. before the replacement can be issued. Postage costs will be refunded to the customer on inspection of the goods by the manufacturer. 8.4 In cases where the rejection is due to an incorrect order from the Customer or to dissatisfaction, the Customer is entitled to a partial refund (full refund less postage costs) only, exchange or credit note. Goods must be returned to Country Attire Ltd. before the partial refund can be issued. A standard charge of £5.00 GBP is chargeable for exchange of goods within the UK, £10 within Europe, £15 Rest of the World. If help is required with sizing please contact us with measurements and we can assist further, via live support section (link), email : customersupport@countryattire.com or 01298 813 300, 8.5 In cases where the customer does not sign for the goods on delivery or for whatever reason, they are not accepted by the customer and returned, we will offer either to re-send the package (which will incur the original shipping charges again – varied according to location), or to refund the original payment minus shipping charges. 9. CANCELLATIONS 9.1 Cancellations are only accepted if the Customer complies with the following cancellation procedure and before the order has been dispatched. If the order has been dispatched prior to the cancellation, the return procedure as defined in clause 8 (8.2 and 8.4) above will apply. If the procedure is not respected, the order will be considered valid and the Customer will remain liable for the full payment. 9.2 Cancellations can be made via the Country Attire Ltd. cancellations email address cancellations@countryattire.com. If the goods have already been dispatched, Country Attire Ltd. cannot refund any monies spent on postage & packaging. (Clause 8.2 & 8.4) Please note that most orders are processed within 5 hours and shipped within 24 hours. 10. PRIVACY POLICY Any information passed through to countryattire.com is via a secure connection on the internet using Secure Socket Layer technology at 128bit encryption (where browsers will allow). If a customer wishes for their information to be removed from our database, this should be requested in writing at our registered office (please see below) or to info@countryattire.com. Please note credit card details are not retained. The only information stored is a customer's transaction history, name, address & e-mail address. These may be used for marketing purposes by Country Attire Ltd.. Customers will not be sent 'spam' e-mail. Should any customer not want their details used for marketing purposes, please tick the relevant box at the checkout or request to be removed at remove@countryattire.com. 10. LICENCE AGREEMENT The Customer shall respect all license agreements delivered by the copyright owners. countryattire.com cannot be held responsible or liable for any misuses conducted by the Customer or any third party. All trademarks, graphics and pictures shown on countryattire.com belong to their registered owners and must not be copied without prior permission. 11. LAW These terms and conditions are governed and shall be interpreted in accordance with English Law. Any person attempting to make fraudulent credit card transactions will be prosecuted with no exception. 12. BUSINESS ADDRESS
Returns Dept Currency Guide The exchange rates are updated daily from an external site. The prices shown in your currency may vary slightly to what you actually pay. This depends on the daily exchange rate used by your credit card company and associated cost when converting the GBP price to your currency. PAYMENT For security we provide only one online method of payment. This is by credit card (Mastercard,Visa, Delta Switch Maestro and American Express). We do not record or store any credit card numbers, all transactions are dealt with by Protx (http://www.protx.com/products/shoppervsp.asp) - a secure online payment company using encrypted information on a secure server. If you require to pay via another method please contact us BEFORE ordering for further instruction. V.A.T. Value Added Tax (VAT) is a European Union sales tax (IVA). In the UK it is charged on most goods at a rate of 17.5%. We currently charge VAT on our goods* delivered by us in the European Union, this includes BFPO addresses within Europe. If the delivery address is not in the European Union then VAT is not payable. *VAT is also not currently applicable to Children's clothing. Although VAT is not charged to customers resident outside the European Union, the price paid is the same as postage costs are higher. Our prices include delivery to any location Worldwide. |
